## 1. DEFINITIONS AND INTERPRETATION

In these Terms and Conditions, the following terms shall have the meanings set out below:

- **"Company", "We", "Us", "Our"** means Rise Aerial Acrobatics
- **"Client", "You", "Your"** means the person booking and/or participating in our services
- **"Services"** means aerial acrobatics classes, workshops, training sessions, and related activities
- **"Premises"** means the studio facilities operated by Rise Aerial Acrobatics
- **"Equipment"** means all aerial apparatus, safety equipment, and related materials
- **"Instructor"** means qualified aerial acrobatics teachers employed or contracted by the Company

## 2. ACCEPTANCE OF TERMS

By booking, attending, or participating in any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms apply to all Services provided by Rise Aerial Acrobatics.

## 3. HEALTH AND SAFETY

### 3.1 Medical Fitness
- You must be in appropriate physical condition to participate in aerial acrobatics
- You must inform us of any medical conditions, injuries, or physical limitations that may affect your participation
- If you are pregnant, have recently given birth, or have any medical concerns, you must seek medical advice before participating
- You must inform us immediately of any changes to your health or medical condition

### 3.2 Age Requirements
- Participants must be aged 18 or over

### 3.3 Safety Protocols
- You must follow all safety instructions provided by our Instructors
- You must use safety equipment as directed
- You must not attempt moves or techniques beyond your demonstrated ability level
- You must warm up adequately before participating in aerial activities

### 3.4 Prohibited Activities
- No participation while under the influence of alcohol, drugs, or medication that may impair judgment or physical ability
- No use of mobile phones or recording devices in the studio without permission
- No unsupervised use of equipment

## 4. BOOKING AND PAYMENT

### 4.1 Booking Requirements
- All bookings must be made in advance through our designated booking system, Gymcatch
- You must provide accurate personal and contact information
- You must complete our registration process including health questionnaire and liability waiver

### 4.2 Payment Terms
- Payment is required at the time of booking unless otherwise agreed
- We accept payments by Stripe through GymCatch
- Prices are subject to change with 30 days' notice

### 4.3 Package and Membership Terms
- Class packages and memberships have expiry dates as specified at purchase
- Packages and memberships are non-transferable unless specifically stated
- Unused classes or sessions within packages are non-refundable after expiry

## 5. CANCELLATION AND REFUND POLICY

### 5.1 Client Cancellations
- Classes may be cancelled up to 4 hours before the scheduled start time
- Cancellations made with less than 4 hours' notice may result in loss of the session
- No refunds are provided for non-attendance without proper cancellation
- Emergency cancellations due to serious illness or injury may be considered on a case-by-case basis

### 5.2 Company Cancellations
- We reserve the right to cancel classes due to instructor illness, insufficient bookings, or safety concerns
- If we cancel a class, you will receive a full credit for future use or full refund at your choice
- We will provide as much notice as possible of any cancellations

### 5.3 Refund Policy
- Refunds are generally not provided except where required by law
- In exceptional circumstances, partial refunds may be considered at our discretion
- Refunds, where applicable, will be processed within 14 days

## 6. LIABILITY AND INSURANCE

### 6.1 Assumption of Risk
- You acknowledge that aerial acrobatics involves inherent risks including but not limited to falls, rope burns, muscle strains, sprains, fractures, and more serious injuries
- You participate entirely at your own risk and assume full responsibility for any injury or damage
- You understand that these risks cannot be eliminated without compromising the essential nature of the activity

### 6.2 Limitation of Liability
- To the fullest extent permitted by law, Rise Aerial Acrobatics shall not be liable for any direct or indirect injury, loss, or damage arising from your participation
- We maintain appropriate public liability insurance as required by law
- Our liability shall not exceed the cost of the services you have purchased

### 6.3 Indemnification
- You agree to indemnify and hold harmless Rise Aerial Acrobatics, its instructors, and employees against any claims arising from your participation in our Services

## 7. CONDUCT AND BEHAVIOUR

### 7.1 Expected Behaviour
- You must treat all staff, instructors, and other participants with respect
- You must follow all studio rules and safety guidelines
- Disruptive, inappropriate, or unsafe behaviour will result in immediate removal from the premises


### 7.2 Personal Belongings
- The Company is not responsible for loss or damage to personal belongings
- Lockers may be provided but valuables should not be brought to the studio
- Mobile phones must be switched off or on silent during classes

## 8. INTELLECTUAL PROPERTY AND PRIVACY

### 8.1 Photography and Video
- The Company may take photographs or videos during classes for promotional purposes
- By attending classes, you consent to being photographed/filmed unless you specifically opt out
- You may not photograph, film, or record classes without express written permission

### 8.2 Data Protection
- We process personal data in accordance with UK GDPR and our Privacy Policy
- Your personal information will be used solely for the purposes of providing our Services
- We will not share your information with third parties without your consent except as required by law

## 9. SUSPENSIONS AND TERMINATIONS

### 9.1 Right to Refuse Service
- We reserve the right to refuse service to anyone who violates these terms
- We may suspend or terminate access to our Services for safety reasons or misconduct
- No refunds will be provided in cases of termination due to violation of terms

### 9.2 Notice Requirements
- We may terminate these terms by giving 30 days' written notice
- You may terminate by giving written notice in accordance with our cancellation policy

## 10. FORCE MAJEURE

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, government restrictions, pandemics, or other emergencies.

## 11. GENERAL PROVISIONS

### 11.1 Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Rise Aerial Acrobatics and supersede all prior agreements and understandings.

### 11.2 Modifications
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website or notification to registered clients.

### 11.3 Severability
If any provision of these terms is found to be invalid or unenforceable, the remainder shall remain in full force and effect.

### 11.4 Governing Law
These Terms and Conditions are governed by English law and subject to the exclusive jurisdiction of English courts.
